Constitution Rules 2004/05

1. The league shall be called Morecambe and district Pool League.

2. The objects of the league shall be as follows:
(a) To encourage and promote the playing of pool generally and in particular to encourage and promote the playing of pool in the premises of the member clubs, by the promotion of competitions and giving of prizes, and by any other means which may from time to time be determined by the committee of the league.
(b) To provide such social and recreational facilities for the individual members of the member clubs as may be deemed appropriate by the committee of the league in its absolute discretion.

3. Membership of the league shall in the first instance be limited to the member clubs whose names and addresses are specified in the first schedule here to and whose objects are the encouragement and promotion of the playing of pool. Additional clubs may be elected to membership of the league in the absolute discretion of the committee, and the election of new clubs to membership of the league shall be by two-thirds. Majority of the committee members present at the committee meeting called for that purpose in accordance with the provisions of rule 5 of these rules.

4(a) The committee of the league (in these rules referred to as “the committee”) shall consist of the officers of the league, namely the chairman or lady, secretary-,and treasurer,-.results secretary-,competition –secretary, and one other representative from each of the member clubs listed in the first schedule here to. The committee shall in the first year of the existence of the league consist of the individuals whose names are set out in the second schedule here to.
(b) At the annual general meeting of the league officers and ordinary members of the committee shall retire but shall be eligible for re-election. Each candidate for election to the committee shall be proposed by two individuals entitled to vote at the annual meeting by notice in writing handed to the secretary at least five days before the meeting. If there shall only be one candidate for each of the offices of chairman or lady, secretary, and treasurer , results secretary, competition secretary-.then such candidate shall be deemed to have been elected, and if their shall be an equal number of candidates to the number of vacancies for the posts of ordinary members on the committee then such candidates shall be deemed to have been elected provided always that each vacancy on the committee for a representative of each number club shall be open only to bone fide members of such club. Voting shall be by ballot and in case two or more candidates for any one position on the committee receive an equal number of votes the chairperson of the meeting shall have a second and casting vote.

5(a) meetings of the committee may be convened by either the chairperson or the secretary or any other two committee members. At least five days notice of such committee meeting shall be given to all committee officers and members and such notice must given either orally to each officer or member in person or written notice there of to the address-which each committee officer and member shall give to the secretary.
(b) Five committee members shall constitute a quorum. If the votes are equal in relation to any resolution before the committee then the chairperson of the committee shall have a second and casting vote. The proceedings of any committee meeting shall not be invalidated by reason only of the fact that proper notice of such meeting was not received by each committee member provided always that a quorum of committee members are present such meeting.
(c)In the event of a vacancy occurring on the committee between annual general meetings of the league then the committee may appoint any individual member of any of the member clubs to fill such vacancy until the next Annual General meeting providing always that if a vacancy is caused by the resignation removal or retirement (how so ever caused) of a representative of one of the member clubs then the committee shall only appoint to that vacancy an individual member of the same club as the committee member who has resigned retired or been removed. The proceedings of the committee shall not be invalidated by reason only of the fact that such vacancy is not filled provided always that there are at least five remaining committee members (including the officers of the committee.
(d)Any committee member who is absent from three consecutive committee meetings without tendering a reasonable explanation for such absence may be removed from the committee at the discretion of the committee.
(e) In all other circumstances removal of the committee or of individual members thereof shall only take place at a special general meeting of the league called for that purpose.

6. Each number club as afore said shall before the day of every year inform the committee of the number of teams it proposes to enter for the league team competition and each club as afore said shall before the day of in every year pay to the committee the sum of-twenty- five pounds as a registration fee for each of such teams. After that date, no further teams shall be eligible to take part in the league team competition until the day of next following.

7. If for any reason a member club fails to pay such annual sum as may be due from it - in accordance with rule 6 of these rules and neglects to comply with a written request for payment from the committee within fourteen days after the same shall have been received by it then such member club shall be expelled from membership of the league unless an explanation satisfactory to the committee is forth coming within the said period of fourteen days.

8. In addition to the provisions of rule 6 above the committee may from time to time require each member club to make an equal contribution towards any legitimate expenditure which has been or is to be incurred by the committee for and on behalf of the league. If there shall be a dispute as to what shall constitute legitimate expenditure in this context then such dispute shall be referred to a single arbitrator appointed in accordance with the terms of the arbitration act 1950 or any statutory re-enactment there of.

9. Each member club upon joining the league shall be deemed- to have undertaken to accept and comply with these rules and with any other regulations or bye laws which may from time to time-be made by the committee for the general management and organization of the league and for the management and organization-of all league competitions and activities. In addition every individual who shall take part in any competition or activity organized by the committee shall be deemed to have undertaken-to accept and comply with such rules and regulations a bye--laws as a foresaid.

10. In addition to the provisions of rule 7 the committee shall have power to expel any member club which shall in any other way offend against the rules. , regulations and bye laws for the time being of the league. Before any such member club is expelled the secretary of the league shall give to such club-seven clear days written notice of its intentions at a committee meeting convened in accordance with rule 5 of these rules for the purpose of hearing complaints made against such club to expel that club from membership and a representative of such club shall be entitled to attend such committee meeting.-No member club shall be expelled from the league without first having an opportunity of appearing(by its representative) before the league committee and answering the said complaint nor unless two thirds of the committee members then present vote for its expulsion.

11. In addition to the provisions of rule 10 above the league committee shall have the power to expel , suspend or fine (or any combination there of ) any individual member or participant in any of the league competitions which power-may be more particularly defined in the competition regulations which the committee may from time to time make in accordance with rule 13 of these rules.

12. The committee shall manage the affairs of the league in accordance with the rules of the league, and shall-be empowered to act in all circumstances not covered by these rules, and in particular, shall be empowered to make bye laws or regulations for the organization and management of league so far as the same are not inconsistent with the provisions of these rules.

13. The committee in every year arrange such team and individual competitions as they shall in their absolute discretion deem appropriate, and they shall in their absolute discretion make such regulations for the management and organization of such competitions as they shall (in their absolute discretion) deem appropriate . All such - competitions- shall be played strictly in accordance with any such regulations and the committees discretion to all the afore said regulations shall not in any way be restricted either by the - provisions of these rules or otherwise.

14. The committee shall have the power to alter add or otherwise vary these rules at a committee meeting convened in accordance with rule5 here of for such purpose but no such alteration addition or variation shall be effective until the same as been confirmed at the annual general meeting or a special general meeting of the league convened for that purpose providing that nothing-contained in this rule shall be constructed as affecting the committee s powering respect of the matters set out in rule 12 here of unless and until an alteration addition or variation to rule 12 shall become effective. Under- this present rule.

15. The secretary shall prepare and maintain a list of the names and addresses of the member clubs of the league and of the committee members of each of the clubs of the league and of the members of the committee , and shall take the minutes of the proceedings of all league and committee meetings and shall keep all other lists and records relating to the affairs of the league of t he committee as the committee ( in the absolute discretion of the committee shall deem appropriate or necessary. In addition the secretary shall have the duty of general supervision of all arrangements for the competitions which may from time to time be arranged under - these rules.

16. The treasurer shall keep the funds of the league under the general - supervision of and in such place and manner as shall be determined by the committee and shall keep such books of account of the committee as it may from time to time direct and shall prepare an annual statement shall be presented at the annual general meeting for adoption. The committee shall have the power to - expand the league funds in such manner as they think fit for the general benefit of the league provided that the same shall not conflict with the provisions of these rules.

17. A general meeting of the league shall be convened by the committee and shall be held every year not later then the day of to transact the following business:
(a) To receive and , if approved ,adopt the statement of the accounts of the league provided by the treasurer under the rule 15 hereof to the end of the year preceding the meeting.
(b)To consider and, if approved, sanction any alteration of or addition to or variation of the rules submitted and recommended by the committee under rule 14 of these rules.
(c)To elect the chairman-,-secretary, treasurer, and members of the committee in accordance-with the provisions of the foregoing rules.
(d)To appoint an auditor if deemed appropriate and proposed by the committee.
(e) To deal with any other business which the committee may desire to place before the league or which may be properly brought before such meeting. Notice convening the annual general meeting - -shall be sent to the member clubs not less than fourteen days before the meeting and shall specify the matters to be dealt with. Each club shall be responsible for notifying its officers and members individually, any individual bone fide- member of any of any of the member clubs shall be entitled to attend and vote at the annual general meeting and twenty individual members shall constitute a quorum of any such meeting.

18(1). A special general meeting-maybe convened at any time by the committee.
(2) A special general meeting shall be convened within fourteen days from the receipt of a written request signed by not less than ten individual bone fide members of the member clubs specifying the object of the meeting which shall be for one or more of the following purposes:-
(i)To consider, and if approved, sanction any duly made alterations additions or variation to the rules.
(ii) To deal with any special matter which the committee may desire to place before any individual member of the member clubs and which because of urgency or other good reason conveniently await the next annual general meeting.
(iii) To receive or demand the resignation of the committee or - to remove any member or members there of from office except insofar as may be otherwise provided by rule 5 (c) and (d) of these rules.
(iv) To deal with any-special matter which the individual members requiring the meeting may desire with urgency to place before the league and which cannot conveniently await the next annual general meeting.
(v) Notice convening a special general meeting shall be sent in accordance with the provisions of rule 18 hereof and all bone fide individual members of the members club shall be entitled to attend and vote at any such meeting.

19. At general meetings the chairperson of the league shall be the chairperson of the meeting provided that if he or she is unable to attend for any reason - whatsoever a chairman for that meeting shall be elected by individual members present (not being less than quorum) and the chairperson of the meeting-shall have a second or casting vote in the event of an equality of votes.
